We are advising SBS sponsors that training provision evidence is being more stringently assessed than in the past.
Thus, over the last few months some PESE case officers have been requesting Subclass 186/187 TRT nominators to provide the names of employees who undertook the training, to provide evidence that the training was completed and to provide completion certificates.
The MIA was asked to challenge the policy interpretation which required the TRT employers to demonstrate that its Australian employees ‘completed’ the training. The legislative requirement is only that the SBS employer ‘provide’ training to its Australian workforce.
After some discussion with the section, the MIA has managed to secure a change in this interpretation. The Department conceded that this was a valid argument and will focus on requesting information about the training provisions/provider, rather than completion by course participants.
