New International Student Visa Framework – further updates

As we wrote earlier, the new Student Visa framework commences on 1 July 2016.

This framework has only two visas: Subclass 500 (Student) and Subclass 590 (Student Guardian).

The new legislative Instruments have been released to accompany the new framework. The main update is outlined below –

Some visa holders will be precluded from applying for student visas onshore

For example, Subclass 600 Visitor visa – Sponsored Family stream and Approved Destination Status stream – will be unable to apply for a Student Visa in Australia.

This Instrument commences on 1 July 2016.

Evidence of financial capacity for Student and Student Guardian visas

Student visa Subclass 500 will be required to demonstrate sufficient funds to meet the following –

  • travel expenses, and
  • living costs and expenses (annual living costs of $19, 830) for the first 12 months of applicant’s stay
  • annual course fees for the first 12 month of the applicants stay.

Student Guardian visa Subclass 590 will be required to demonstrate sufficient funds to meet –

  • travel expenses
  • living costs and expenses (annual living costs of $19,830) for the first 12 months of applicant’s stay

There are additional sufficient funds requirements for every accompanying family member.

The new legislative Instruments also outlined the approved sources of evidence of financial capacity.

This Instrument commences on 1 July 2016.

English Language test

English language test which must be taken no later than 2 years immediately before the date an application is made, or immediately before a decision is made on an application.

This Instrument commences on 1 July 2016.
